When you or a loved one is arrested or detained by immigration authorities it is critical to get help from a competent immigration attorney.

If you have a family member who is in detention and is not listed at one of the above detention centers we can still help you locate your loved one and inform you of ways we can help. 

Procedure

Attorney Scott D. Weaver will guide you on what to expect when you visit your loved one at the detention center. Once you feel comfortable and understand what to expect, we will visit the client, either virtually, or in person, to review the client's case and immigration history. At that time we will determine the possible areas of relief that he or she is eligible for under U.S. immigration law.

For asylum cases, the client will frequently be subjected to a credible or reasonable fear interview. Many clients need to win the credible or reasonable fear interview before receiving an official bond release from deportation. If the bond is too high and cannot be paid, we may file a motion for bond redetermination in which we ask the immigration judge to lower the bond amount.

Our first priority is to always get your loved one out of immigration detention so that he or she can fight his or her case freely. Sometimes we are able to help clients out of the immigration detention bond center and help them obtain a legal work permit while they are awaiting their trial. We understand that you want to be reunited with your loved one and we work tirelessly to make sure that happens.

You can apply for an immigration bond from the immigration court even if the Department of Homeland Security has not given you an NTA. Our law firm will file a bond hearing motion on your behalf, which will include the reasons why you should be released from custody and able to fight your case outside the walls of the detention center.

When deciding on an appropriate bond the immigration judge will consider a wide variety of factors, including but not limited to:

  • Whether you pose a danger to society;

  • Whether you are likely to go to future hearings to cooperate with all requirements imposed by the U.S. government relating to your immigration case;

  • Your family ties;

  • Community ties;

  • Employment history;

  • Criminal history;

  • The manner in which you entered the United States and the length of time you have resided here;

  • Membership in community organizations; and

  • Likelihood of obtaining permanent residency.
